Security Trusteeship is a contractual arrangement amongst Borrower, Lenders and the Trustee. This arrangement is established by executing a document called Security Trustee Agreement (STA). The securities under the transaction are created in favour of the trustee for the benefit of the lenders.
Our Services Include:
- Advising security creation and related documentation procedure
- Vetting / drafting of security documents in line with sanction terms / loan documents
- Holding of security for the benefit of the lenders’ and ensuring compliance with regulatory filing / registration procedures
- Safe custody of title deeds, security and transaction documents
- Monitoring of security cover (transaction specific), disposal and substitution of existing securities
- Monitoring of endorsement of insurance policies / obtaining insurance policies as per lenders’ instructions
- Investigation of title / site inspection of the property / pay or discharge any tax levied\on security document upon instructions of the lenders
- Enforcement of security as per the terms of the security documents Managing enforcement proceeds as per waterfall mechanism
